Explanation:
On June 10, 2025, the Broward County Commission ("County") approved a Third Amendment to the Surtax ILA ("Third Amendment"), attached as Exhibit "1". To become effective, the commissions/councils of municipalities with at least 50% of the County's total population must approve this Third Amendment along with the County.

This amendment added additional municipalities and the Broward County City Managers' Association, Inc. ("BCCMA") as parties to the Surtax ILA. Additionally, it fully restated the Surtax ILA among its members. Among other modifications, the proposed is intended to streamline, simplify, and broaden annual municipal access to transportation surtax revenues using a formula allocation for each participating municipality to supplement (and not supplant) existing city funding. Some featured items include:

1. Identifying ways to address the status of the remaining Cycle 1 Projects and the ability for the County to terminate such projects that are not under a Surtax Funding Agreement.

2. Reprioritize the current distribution of Transportation System Surtax funding to municipalities among Community Shuttle, Capital Projects, and Rehabilitation and Maintenance ("R&M") Projects.

3. Provide for a new formula-based funding model and allocation utilizing Municipal Centerline Mileage for R&M Projects and on-demand transportation.

4. Expanding and clarifying definitions of eligible uses to include Micro-transit, subject to certain criteria and limitation.
