Explanation:

The City has engaged Ogletree, Deakins, Nash, Smoak & Stewart, P.C. (“Law Firm”) to provide legal services in various matters arising out of the City’s declarations of financial urgency in 2010 and 2011.  Section 38.40(C)(2) of the Code of Ordinances exempts from the competitive bid and competitive proposal requirements of the Purchasing Ordinance contracts for professional services.  When professional services are purchased and the estimated annual amount to be paid for such services by the City exceeds $50,000.00, City Commission approval is required.

 

The fees paid to the Law Firm for FY 2019 were approaching $50,000.00.  The City Attorney estimated that the amount of fees that would be paid to the Law Firm for FY 2019 would approach but not exceed $75,000.00.  On September 4, 2019, the City Commission adopted Resolution No. R-2019-248, which increased the amount of fees authorized to be paid to the Law Firm from $50,000.00 to $75,000.00. 

 

The Law Firm has submitted a final bill for FY 2019 that brings the total fees for FY 2019 to $80,238.30.  This bill can be paid only with the approval of the City Commission.
