Explanation:
The City of Hollywood would like to maintain the Florida East Coast Railway, LLC ("Railway") corridor at a higher level of maintenance than what is currently being provided by the Railway. This corridor spans from Pembroke Road to Sheridan Street between Dixie Highway and 21st Avenue. Currently, the City is prohibited from performing any maintenance activity within 25' of the centerline of the closest rail as this is considered Railway right-of-way.
With this signed agreement, the Railway would allow the City and/or any of our subcontractors, after completing a Railway Worker Protection on-line class, access to this right-of-way to perform mowing, weed control, and litter pickup within 5' of the stone edge of the railway.
The Public Works Director recommends that the City Commission authorize the appropriate City officials to execute a release and indemnification agreement with the Florida East Coast Railway, LLC to performance general landscape maintenance.
Fiscal Impact:
Approval of this Resolution will not fiscally impact the City as this is an agreement to execute a release and indemnification agreement with Florida East Coast railway, LLC to provide permission for the City to enter the Railway's right-of-way property.
