Explanation:
University Station I, LLC. is the developer of a mixed-use development project with 216 residential units and 2,920 square feet of commercial use, a public/private parking garage and incorporates existing Barry University. The City is the owner of the development parcels and the project is generally located along the east side of North 21st Avenue between Polk Street and Fillmore Street.

As part of the City's development approval for the Project, the Developer is constructing landscape, irrigation, and pavers improvements to enhance the Project's frontage along North 21st Avenue. North 21st Avenue is within the jurisdictional roadways system of Broward County. Broward County requires the attached Revocable License Agreement, Exhibit "i", between the County, the City and the Developer to be executed.

As the City is a party to the County's agreement, the attached maintenance agreement in Exhibit "ii", between the City and the Developer establishes maintenance responsibilities and understanding for the improvements. In the maintenance agreement, the Developer is required to maintain the improvements at no cost to the City.

The City is required to enter into these agreements since the City owns the property being developed (landlord and landlord-tenant).


Fiscal Impact:
Approval of the Resolution will not fiscally impact the City.
