Explanation:
On February 28, 2023, Michael Ortiz (“Claimant”) filed a civil action against the City seeking damages arising out of an incident involving City of Hollywood Police Officers that occurred on July 3, 2021. The City Attorney, on behalf of the City and its employees, and Claimant’s attorney have negotiated a settlement for the full amount of the City’s excess liability insurance limits ($1,000,000.00) and the balance of the self-insured retention policy after the City’s attorney’s fees and costs are paid therefrom, a total value of $1,320,688.87.
If this settlement is approved by the City Commission, the monies will be paid from the City’s self-insurance fund and the City’s excess liability insurance.
This Resolution seeks to clarify the prior-entered resolution, R-2025-339, entered on October 9, 2025, and to specify an exact settlement value to the Claimant.
Fiscal Impact:
Funding for this settlement is available in the City’s self-insurance fund and the City’s excess liability insurance.
