Explanation:

On March 16, 2016, the City Commission passed and adopted Resolution No. R-016-067 which approved a Site Plan for a 316 space public parking garage with retail uses generally located at 327 Nebraska Street (the “Garage”). The Community Redevelopment Agency (“CRA”) was in charge of constructing the Garage. Per the Broward County Trafficways Plan, a five-foot strip of land along A1A adjacent to the Garage between Nevada Street and Nebraska Street is required to be transfer and dedicated to the Florida Department of Transportation (“FDOT”).

 

The CRA contacted FDOT and was requested by FDOT to apply to transfer the land. The CRA submitted to the FDOT an application for the transfer. FDOT reviewed and accepted the transfer application subject to executing certain documents and one of the documents requested is the attached Partial Release of Declaration of Unity of Title to be executed by the appropriated City officials. The City Commission, in Resolution R-2016-067, imposed a Unity of Title on the Site Plan for the Garage, and only the City Commission can partially release the Unity of Title.

 

Fiscal Impact:

Approval of this resolution will not fiscally impact the City.
