Staff Recommends: The Office of Human Resources recommends that the City Commission approve the Resolution authorizing the execution of a Change Order to the Agreement with South Broward Hospital District, d/b/a Memorial Healthcare System, to include a Business Associate Agreement and Supplemental Terms for the operation of the Employee Health Center.
Explanation:
On February 21, 2024, the City Commission adopted Resolution No. R-2024-053, approving an Agreement with South Broward Hospital District, d/b/a Memorial Healthcare System ("Memorial"), for the operation of the City's Employee Health Center (EHC) in an estimated amount up to $5,463,978 over a three-year term.
The Employee Health Center provides primary care, occupational health, screenings, immunizations, and other services to eligible City employees, retirees, and dependents.
The City now seeks to revise the existing Agreement with Memorial by adding a Business Associate Agreement (BAA) and Supplemental Terms to ensure compliance with the Health Insurance Portability and Accountability Act (HIPAA). This change will authorize Memorial to share necessary Protected Health Information (PHI) with the City of Hollywood Human Resources and Risk Management Department in connection with pre-employment physical examinations, hazardous materials (HAZMAT) physicals, and related occupational health services.
