Explanation:

During the 2023 Legislative Session, the Florida Legislature adopted updates to Chapter 166.0335, Florida Statutes, which limited a municipality’s ability to prohibit a residential property owner from establishing a temporary shelter on his/her property during a declared emergency in which a permanent residential structure is damaged and rendered uninhabitable.

 

The updated state statute, passed following the devastation caused by Hurricane Ian in September of 2022, supersedes municipal code and renders Chapter 40.08 of the Hollywood Code of Ordinances non-compliant with Florida law. City of Hollywood staff is recommending updates to Chapter 40.08 of the City’s Code of Ordinances, as well as its policies and procedures regarding emergency temporary sheltering, to ensure compliance with Florida law.

 

 

Fiscal Impact:

Approval of the attached ordinance will not fiscally impact the City.
