Explanation:
The Police Department requires the purchase of Tasers and associated equipment in order to enhance the capabilities of immobilizing violent suspects.
When deployed, Tasers can immediately immobilize violent suspects, thereby offering a greater measure of safety to police officers.
The existing Taser models X26 have served their usefulness of life and are no longer reliable nor covered under warranty.
The Police Department has identified the Taser model X2 as meeting the department's operational needs.
The hand-held Tasers are only available from the manufacturer, Taser International, Inc., who is the sole source supplier of the hand-held Taser X2 specifically designed for law enforcement use.
Taser International is offering a trade-in amount for the old X26 model Tasers valued at $46,350, which will off-set a part of the cost for the purchase of the new X2 Tasers.
Purchasing Ordinance 38.40(C)(3) provides that, non-competitive supplies, and sole source services available from only one source, such as unique, patented, franchised supplies, or services, are exempt from the competitive proposal requirements.
The purchase of a Police issued Taser is not normally budgeted and serves as a legitimate law enforcement purpose.
