Explanation:

The City has engaged the law firm of Ogletree, Deakins, Nash, Smoak & Stewart, P.C. (“Ogletree Deakins”) to provide legal services in various matters, including labor and employment.

 

Section 38.41(C)(11)(i) of the Procurement Ordinance exempts contracts for professional services from the competitive bid and competitive proposal requirements of the Procurement Ordinance.  When professional services are contracted and the estimated annual amount to be paid for those services exceeds $100,000.00, City Commission approval is required. The City Attorney recommends that the City Commission approve the expenditure of an amount up to $175,000.000 for matters handled by Ogletree Deakins. It is currently unknown whether the full authorized amount will be necessary, but in an abundance of caution, it is requested increased funds be allocated.

 

The City Attorney recommends that the City Commission approve a $75,000.00 increase the expenditure for a total amount up to $175,000.00 for matters handled by Ogletree Deakins.

 

 

Fiscal Impact:

Funding for this agreement is available in the FY 2024 Operating Budget in account number 001.020101.51400.531220.000000.000.000.
