Title
A Resolution Of The City Commission Of The City Of Hollywood, Florida, Authorizing The City Attorney To File Civil Actions, On Accounts With Balances That Exceed $200.00, To Collect Unpaid Charges Under The 50/50 Shared Cost Sidewalk Program.

Body

Staff Recommends:  Approval of the Resolution.

Explanation:
The City currently has several accounts with unpaid charges under the 50/50 Shared Cost Sidewalk Program.  Final notices have been sent with respect to many of these unpaid charges.

Section 7.02(b)(4) of the Charter of the City of Hollywood requires the City Attorney, when requested to do so by resolution of the City Commission, to prosecute and defend on behalf of the City all complaints, suits and controversies in which the City is a party.  The collection of unpaid charges under the 50/50 Shared Cost Sidewalk Program is an ongoing process, and the Department of Financial Services has requested that the City Attorney seek City Commission approval of the filing of civil actions for the collection of such charges, both currently existing and arising in the future, and to seek any and all appropriate remedies.

The City Commission has determined that filing civil actions only on individual accounts with balances that exceed $200.00 would be in the best interest of the City.
