Explanation:
The City has engaged Ogletree, Deakins, Nash, Smoak & Stewart, P.C. (the “Law Firm”) to provide legal services in various matters arising out of the City’s declarations of financial urgency in 2010 and 2011. Section 38.40(C)(2) of the Code of Ordinances exempts from the competitive bid and competitive proposal requirements of the Purchasing Ordinance contracts for professional services. When professional services are purchased and the estimated annual amount to be paid for such services by the City exceeds $50,000.00, City Commission approval is required.
On May 2, 2018, the City Commission adopted Resolution No. R-2018-122, which increased the total amount authorized to be paid to the Law Firm for FY 2018 from $50,000.00 to $80,000.00. The fees paid to the Law Firm for FY 2018 are approaching $80,000.00. The City Attorney estimates that the amount of fees that will be paid to the Law Firm for FY 2018 will approach but not exceed $120,000.00.
Funding has been identified and is available in the FY 2018 budget in Account No. 01.0104.00000.514.003126.
