Staff Recommends: Approval of the attached Ordinance.

Explanation:
On April 10, 2014 the Planning and Development Board (Board) forwarded a recommendation (6-1) of denial to the City Commission to amend the Zoning and Land Development Regulations to limit reconsideration of any development action-whether approved or denied-for one year.

The Board expressed concerns that the proposed amendment may hinder redevelopment by creating unintended consequences, such as:
- A year wait may affect market conditions and financial obligations;
- Limit tenant modifications for spec buildings for example, sign variances;
- During the construction document process, as other disciplines are involved, there may be additional considerations or different efficiencies that may require amending the Design or Site Plan.

In response to the Board's concerns, the exemption portion of the proposed Ordinance was clarified and proposes to exempt (NOT subject to the one year limitation):

Historic Designations;
-Text Amendments;
-Certificates of Appropriateness for Design, Variances, Administrative Variances of single-family homes and multifamily dwellings of four or less units;
-Undeveloped portions of property included in a Site Plan designated for future development;
-Sign Variances for individual tenants in non-residential areas; and
-Minor modifications as defined in Section 6.26 of Article 6 of the Zoning and Land Development Regulations.

Should the City Commission pass the proposed Ordinance at Frist Reading, a fee will need to be established at Second Reading.
