Staff Recommends: Approval of the attached Resolution.

Explanation:
Since February 1997, the City has provided fire protection and rescue services to the Hollywood Seminole Indian Reservation.

The proposed Interlocal Agreement for Primary Fire Protection and Supplemental Emergency Medical Services (the "Interlocal Agreement") shall be effective upon execution by the City and continue through September 30, 2026.

The Interlocal Agreement shall automatically renew for successive one-year periods unless terminated by either party; and the Interlocal Agreement provides that the Tribe shall pay the City $858,429.00 for the first year, and thereafter the fee will increase by 3%.

It has been determined that the revenue proceeds received pursuant to the Interlocal Agreement shall be allocated to a capital project account for the purpose of funding capital improvements within the Fire Department.

The Tribe has designated its Fire Rescue Department as a covered entity under HIPPA and is required to enter into a written agreement with the City to protect the privacy and security of certain health information maintained by the Tribe and classified as Protected Health Information.

The Fire Chief recommends that the City Commission approve the execution of the attached Interlocal Agreement and Business Associate Agreement.


Fiscal Impact:
The City will receive $858,429.00 from the Seminole Tribe of Florida for Primary Fire Protection and Supplemental Emergency Medical Services in the first year of the agreement. The fee will increase by 3% per year thereafter.
