Staff Recommends: Approval of the attached Ordinance.


Explanation:
On April 11, 2013, the Planning and Development Board (PDB) forwarded a recommendation of approval to the City Commission for rezoning of the property generally located south of Stirling Road and adjacent to North 31st Terrace.

The requested change in zoning designation is a result of the property maintaining a land use of Low Medium Residential, similar to surrounding uses. However, the zoning of the property is currently Low/Medium Intensity Commercial (C-2). State law and the Comprehensive Plan required properties to have a zoning designation consistent with the land use. As such, the request to change the zoning designation from Low/Medium Intensity Commercial (C-2) to Low-Medium Multiple Family District (RM-9) will satisfy this requirement.

Although the Commission is only considering the Rezoning, the Applicant has been working with City Staff in order to ensure adequate vehicular and fire access could be provided at the time of construction. A schematic plan has been submitted as part of Attachment II.

RECOMMENDATION

Staff finds the proposed rezoning from Low-Medium Intensity Commercial (C-2) to Low-Medium Multiple Family District (RM-9) to be consistent with the Zoning and Land Development Regulations as well as the City-Wide Master Plan and therefore recommends approval.
