SECOND READING:
Following the first reading on September 4, 2024, City Commission directed staff to remove the prohibition on adult uses, proposed during first reading. The proposed ordinance for second reading retains the prohibition on smoke shops but eliminates the prohibition on adult uses.
Staff has also included the C-1 Low Intensity Commercial District within the Ordinance, which was erroneously omitted in first reading.
In accordance with the Article 11 of the City's Code of Ordinance, the operation or expansion of adult entertainment establishments is limited. No individual or entity shall propose, initiate, or permit the operation or expansion of an adult entertainment establishment, except where such expansion is legally mandated. These establishments are only permitted within the following zoning districts: C-1, C-2, C-3, C-4, C-5, IM-1, IM-2, IM-3, IM-4, and PEDD. While the there is a C-1 Zone located on east of the Intracostal, required distance separations, inlcuding from residential zones would automatically prohibit the establishment of an adult use.
Also, considered Adult Uses are body piercing, tanning and tattoo establishments, which are only permitted within IM-1 zoning districts and also require distance separations.
