Explanation:

Greenberg Traurig, P.A. (“GT”) represents the City in legal matters involving the six Large Users of the Southern Regional Wastewater Treatment Plant (“SRWWTP”) and the City’s utility system, primarily involving ongoing issues with the City of Pembroke Pines.

 

Section 38.41(C)(11)(i) of the Procurement Code exempts contracts for professional services from competitive bid and proposal requirements. 

 

Legal services are anticipated to continue to be required from GT throughout FY 2026.  The City of Pembroke Pines previously filed three SRWWTP related civil actions and the issues are complex.  The City of Dania Beach has also filed SRWWTP related litigation.  GT has devoted, and anticipates continuing to devote, extensive time to the City’s defense in these matters.  These will likely continue to be litigated for several years. 

 

Department of Public Utilities Staff requested a proposal from GT for continued legal services.  GT responded with the attached FY 2026 Agreement, which would authorize the payment of fees in an amount up to $500,000.00 for the matters set forth in the Agreement.

 

 

Fiscal Impact:

Funding for this agreement will be available in FY 2026 Operating Budget in account number 442.400101.53600.531220.000000.000.000, subject to approval and adoption by the City Commission.
