FIRST READING:

In 2025 the Florida Legislature amended §327.60(2)(f), Florida Statutes to create an exception to the general preemption on local regulation of anchoring, allowing municipalities in counties with a population of more than 1.5 million to regulate vessels that anchor overnight for more than 30 days in any 6-month period.

 

The ordinance amends Chapter 98 of the Code of Ordinances to prohibit vessels from anchoring overnight for more than 30 days in any 6-month period.  “Overnight” is defined as one-half hour after sunset and one-half hour before sunrise for one hour or more.

 

Vessels which are the subject of 3 or more violations in a 12-month period shall be declared a public nuisance and subject to removal, pursuant to §823.11, Florida Statutes. 

 

The penalty provisions of Chapter 98 were also revised for clarification and simplicity purposes, as there are multiple references to different sections.  

 

 

Fiscal Impact:

This initiative will use current resources and staffing, with no additional cost to the City.
