Explanation:

Since the inception of the Beach Management Program in the late 1960s, Broward County (“County”) has acted as the local sponsor for the U.S. Army Corps of Engineers (“Corps”) Segment III SPP (“Segment III SPP”) through Interlocal Agreement, which includes sand replenishment projects above and below mean high water, dune projects, beach tilling, and escarpment removal.

 

The County holds a Consolidated Joint Coastal Permit and Sovereign Submerged Lands Authorization issued by the Florida Department of Environmental Protection (“FDEP”), Permit number 0163435-015-JC (“Permit”), as may be amended, to perform sand replenishment projects above and below mean high water, dune projects, beach tilling, escarpment removal, and other activities as part of the Segment III SPP. Facilitation of the Segment III SPP occurs at various locations, including City’s property.

 

Established dunes provide protection to upland properties and infrastructure by serving as a buffer from storm damage and flooding by coastal waves and elevated sea levels. Dunes also help prevent beach erosion caused by increased high tide and king tide events.

 

On October 21, 2020, the City Commission approved Resolution R-2020-278 adopting the City’s Dune Master Plan. The Dune Master Plan, as developed, is consistent with the goals of the City’s Sustainability Action Plan, which outlines a management approach that addresses both improvements to existing dune features and new dunes/vegetation.

 

On February 21, 2024, the City Commission approved Resolution R-2024-057 amending the maximum height of dune crest elevation to 8.4 NAVD to meet the Broward County requirements to complete the dune design for the Shore Protection Project Segment III.

 

Dune health and overall height helps prevent breaches and overtopping from waves that can wash out or damage upland property and structures. Vegetated dunes provide habitat to distinct regional biota that are well adapted to survive beach conditions (salt spray, periodic saltwater inundation, periodic drought, soil erosion, dune migration, and harsh winds). Furthermore, Hollywood Beach supports between 100 to 150 marine turtle nests annually, with each nest averaging 110 eggs, resulting in thousands of hatchling turtles during the year.

 

The County has completed the design for the dune implementation project included as Exhibit “A” of this resolution. The City desires to grant such access to the County in accordance with the terms set forth herein so that the County may help facilitate and complete the Segment III SPP.

 

The City previously authorized County to access and use the Property to perform beach tilling and escarpment removal activities required by the FDEP Permit. The County desires continued access on, over, across, and through the Property for the purpose of facilitating the design, construction, installation, inspection, and maintenance of the Segment III SPP.

 

The Department of Design and Construction Management (“DCM”) recommends that the City Commission authorize the appropriate City officials to execute an Agreement with Broward County for the access and use of City property for the Shore Protection Project, Segment III.
