Explanation:
On March 12, 2019, the City held a Special Election wherein a majority of voters approved funding in the amount of $14,091,065.00, through a General Obligation Bond (GO Bond), for the Tidal Flooding Mitigation and Shoreline Protection Project (“Project”). The Project’s purpose was to provide tidal barriers to the City-owned properties most vulnerable to tidal flooding, around the two man-made inlets known as North Lake and South Lake.
The Project was divided into 22 smaller projects, matching the parcel map, and classified by phases. Eight locations were classified as Phase 1 projects and were slated for completion under the GO Bond project scope.
The City secured a design consultant for the project, approved under R-2020-275. The contract stipulated that the design for Phase 1 projects be developed from survey, planning, permitting, final design and construction engineering services. Fourteen projects were classified as either Phase 2 or Phase 3 projects. The scope of services included only the development of conceptual design for Phases 2 and 3. These conceptual drawings were utilized to apply for grant funding.
The Department of Design and Construction Management (“DCM”), on behalf of the City, submitted a grant application to the State of Florida Department of Environmental Protection (“FDEP”) for funding through its Resilient Florida Grant Program, in the amount of $13,908,935.00, to assist in funding the design and construction of the Phase 2 and 3 projects.
FDEP awarded the City a total of $14,112,000.00 to fund the design and construction of the remaining Phase 2 and 3 projects. On September 21, 2022, the City Commission passed and adopted Resolution No. R-2022-281, approving the appropriate City officials to accept and execute FDEP Resilient Florida Grant (“Agreement No. 22FRP13”) and authorizing the required matching funds to be paid from the GO Bond.
FDEP requested updates to Agreement No. 22FRP13’s exhibits and attachments (“Amendment 1”), and the revised Grant Work Plan providing for the City to fund all design and construction administration costs which will count as grant match. The City is to fund construction costs not less than $12,204,935.00 and FDEP to fund construction costs up to $14,112,000.00.
FDEP also requested the project be titled “Hollywood Tidal Flooding Mitigation and Shoreline Protection” going forward. This Amendment 1 was approved by the City Commission on December 6, 2023; also approving and authorizing the appropriate City Officials to execute all applicable grant documents, agreements and amendments.
FDEP grant Amendment 2, includes an additional grant award of $4,211,301.45 for a total award of $18,323,301.45, requires construction using FDEP funds to be completed by June 30, 2026.
On March 5, 2025, the City Commission passed and adopted Resolution No. R-2025-072, awarding Invitation for Bid IFB-267-25-WV for Hollywood Tidal Flooding Mitigation and Shoreline Protection Project Sites 3,4,5,11,12,7,8,14,15 & 16 FDEP 22FRP13 (“IFB-267-25-WV") to Shoreline Foundation, Inc. in the amount up to $3,648,808.00. (Group A). Sites 12 and 15 were removed from the project during preconstruction, when staff learned Site 12 was controlled by a License Agreement executed between the City and an adjacent property owner and Site 15 seawall was recently reconstructed at elevation +4.5 NAVD by an adjacent property owner.
The remaining FDEP funds, plus any required City funds, will be used to fund Sites 9,10,17, 19, 2, 22, 1, 18. The remaining sites from the 22 included in the original grant scope are still under design and permitting. These Sites are 6,13,20 and 21 which are part of the Pre-Construction Services Agreement with The Whiting Turner Contracting Company, the Guaranteed Maximum Price (“GMP”) proposal for those sites is anticipated for early 2026. The City has a pending grant funding request with FDEP if additional funding is required to complete these four sites.
On April 2, 2025, the City Commission passed and adopted Resolution No. R-2025-093, ranking Construction Management at Risk (“CMAR”) firms and authorizing the appropriate City officials to negotiate and execute a Phase 1 Pre-Construction Services Agreement with the highest-ranked firm to provide CMAR services for the Project, a GOB project.
On May 14, 2025, a CMAR Phase I Pre-Construction Services Agreement was executed with The Whiting-Turner Contracting Company for the Project, pursuant to Resolution No. R-2025-093, in an amount up to $130,000.00 for Sites 9,10,17,19, 2, 22,1,18, 20, 21,6 & 13.
The Whiting-Turner Contracting Company Phase I Pre-Construction services is completed for Sites 9,10,17,19,2,22,1 & 18, and they have provided the Department of Design and Construction Management (“DCM”) with a GMP proposal for CMAR Phase II Construction Services for the Project, for Sites 9,10,17,19,2,22,1 & 18 in an amount up to $18,874,861.00, for which DCM staff is in the final phase of negotiations. The current proposed GMP is within the City’s budget and grant funding allocation.
An owner allowance of $1,887,486.00 will be included in the GMP amount for unforeseen conditions which shall only be used as requested by staff with the remaining value to be returned to the City.
The FDEP grant requires the City to complete the project by June 30, 2026. This requirement is tied to the funding source and requires the City to spend the funding prior to this due date. Given the critical nature of the Project’s timeline, approval of this item will allow staff to expedite the execution of the contract, to begin procurement of subcontracts, and to move ahead on the long lead items for this project.
The Deputy Director of DCM recommends that the City Commission approve and authorize the execution of a Construction Management at Risk Phase II Construction Services Agreement for the Hollywood Tidal Flooding Mitigation and Shoreline Restoration project FDEP-22 FRP13, for Sites 9,10,17,19,2,22,1 & 18, in an amount up to $20,762,347.00, inclusive of owner allowance.
