Explanation:
On October 6, 2021, the CRA Board passed and adopted Resolution No. R-BCRA-2021-52, approving a Contract in an amount up to $12,805,794.98 with Burkhardt Construction Inc (“Burkhardt”) for Undergrounding of Overhead Utilities and Streetscape beautification from Hollywood Boulevard to Sheridan Street and on November 17, 2021, the CRA issued a construction notice to proceed advising Burkhardt to mobilize by January 17, 2022, and be substantially complete by July 17, 2024.
On January 17, 2024, the CRA Board passed and adopted Resolution No. R-BCRA-2024-05, authorizing a change order with Burkhardt for a Pedestrian Crossing Mast Arm at the intersection of Carolina Street and SR A1A increasing the contract amount to $13,425,883.67 and extending the contract completion date 240 calendar days, to March 14, 2025, however CRA staff inadvertently failed to submit the second change order to the Board in a timely manner.
On June 4, 2024, the CRA issued a certificate of substantial completion for the original contract scope, except for the undergrounding activities, still to be completed and coordinated with the utility companies.
In order to install the Carolina Street and SR A1A pedestrian crossing, electrical life overhead lines need to be removed or temporarily shut down, due to the installation equipment size required to install the mast arm.
The CRA Executive Director recommends that the CRA Board approve and authorize the issuance of a second change order to Burkhardt Construction Inc., for a no cost increase to the Contract time from 1153 calendar days to 1811 calendar days, requiring and contract extension of an additional 658 calendar days to complete the undergrounding and third parties coordination, removal of the overhead lines and the installation of the noted signal, and in order to add an additional scope of work to an existing construction contract, a change order must be issued.
It is required by applicable rules and regulations that the CRA follow all City Procurement policies and procedures, Section 38.48(A) of the Procurement Code states that a change order means changes, due to unanticipated conditions or developments, made to any contract, which are reasonably and conscientiously viewed as being in fulfillment of the original scope of the contract and/or matters directly related thereto and all change orders that the CRA Executive Director is not authorized to approve must be formally approved by the CRA Board, which includes this desired change order.
The Executive Director of the CRA recommends that the Board authorize the appropriate CRA officials to execute the attached Second Change Order with Burkhardt, to extend the contract time for an additional 658 calendar days with no additional cost to the contract.
