Explanation:

The City of Hollywood (“City”) acquired approximately 1.41 acres of beach property from Broward County (“County”) in 2004 agreeing to maintain and conserve the property in accordance with the requirements of the 2000 Safe Parks and Land Preservation Bond under which the County obtained funding to purchase the property in 2002.  The County now seeks the return of the land for environmental mitigation related to projects at Port Everglades.  The County intends for the land to continue to be conserved as open space becoming part of the Dr. Von Mizell - Eula Johnson State Park. 

 

The transfer of the land to Broward County will relieve Hollywood of the current obligation to maintain the property and will ensure the property continues to be preserved as open space/recreational land subject to a restrictive covenant.  The County will also agree to a perpetual easement for a future recreational trail planned through this area pending approval from the Florida Department of Environmental Protection and the City of Dania Beach. 

 

This resolution is to grant approval to place an item on the November 3, 2026 election ballot seeking the approval of the electorate to sell/convey/dispose of the property, in accordance with the City Charter. The proposed ballot language is attached as Exhibit A.

 

City Charter Section 13.01 (C), Sale of City-Owned Real Property, states that any real property which is beach or beachfront which the City proposes to sell or to otherwise dispose of, must be approved by a majority vote of the City's electors voting on such proposal. The City Charter further states that any property which the City proposes to sell or otherwise dispose of must be appraised. However, property which is listed by the Broward County Property Appraiser as having a value of not more than twenty-five thousand dollars ($25.000.00) may be sold or disposed of without an appraisal.  The City had the land appraised and the value of the land, due to the conservation easement, lack of access, and location east of the Coastal Construction Control Line, is appraised at $10,000.00.

 

If this referendum is approved by a majority of the electors voting, such approval shall take effect as of the day immediately following the certification of the results of the referendum.   Broward County will be responsible for any closing costs and recording fees, associated with the transfer of the ownership of the property and the restrictive covenant maintaining the lands as open space/recreation. 

 

 

Fiscal Impact:

Funding for the local election as part of the November General Elections has been provided for in the FY 2026 Budget and any additional funding required will be allocated in FY 2027 subject to City Commission approval.
