Explanation:

The Department of Design and Construction Management (“DCM”) is in the process of implementing improvements to Holland Park, a General Obligation Bond Project, which includes the interior renovation of existing restrooms and docks.

 

In order to complete these improvements, DCM executed a Pre-Construction Services Agreement with D. Stephenson Construction, Inc. (“D. Stephenson”), which is one of the firms selected from the City’s existing Construction Management at Risk Continuing Services Agreements, and approved in Resolution R-2019-025.

 

On May 20, 2021, the City and D. Stephenson executed a Continuing Services Agreement to provide Phase I preconstruction services for this project in the amount of $9,000.00 and later negotiated a change order for additional services in the amount of  $2,500.00, for a total contract amount of $11,500.00.

 

After thoroughly evaluating the proposed Guaranteed Maximum Price and allocated budget for the project, it was decided to competitively bid out the project to maximize project savings.

 

Article 8, Section 8.4 of the agreement provides that the City may terminate the agreement for convenience.

 

The Director of the Department of Design and Construction Management is recommending that the agreement be terminated for convenience.

 

Pursuant to Section 38.49 of the Procurement Code, when a contract is entered into by the City Commission without cause, only the City Commission is authorized to terminate the contract without cause.

 

Fiscal Impact:

Approval of this Resolution will not fiscally impact the City as this is an approval of the termination of the Phase I Preconstruction Services Agreement with D. Stephenson Construction, Inc.
