Explanation:
Palm Beach 2000, Inc. is the owner of the lands within the “Hollywood Plaza” Plat, and has filed an application to revise the concurrency note on the Plat, clarifying and limiting the uses thereon. The parcels within the Plat are being developed by the owner in stages which began with the Walmart development parcel. As the site planning for the balance of the property is being finalized, the original uses depicted in the original restrictive concurrency note must be revised to reflect the confirmed uses/tenants being developed. The owner desires to revise the note to be consistent with current development plans which shifts 13,000 commercial use square footage from Parcel C to Parcel A, identifies the square footage of convenience store with service station use and converts 7,000 bank square footage use within Parcel A to an equal amount of commercial use. The existing and proposed note language is provided below for further clarification.
The current plat note reads as follows:
This plat is restricted to a 26 fuel position service station with a convenience store, 10,000 square feet of commercial use and 7,000 square feet of bank use on Parcel A; 218,000 square feet of commercial use on Parcel B; 60,000 square feet of commercial use and 6,000 square feet of bank use on Parcel C; and 223,000 square feet of commercial use (124,000 square feet existing and 99,000 square feet proposed) on Parcel D. Freestanding banks and drive-thru bank facilities are not permitted within the commercial uses without the approval of the Board of County Commissioners who shall review and address these uses for increased impacts.
The proposed plat note will read as follows:
This plat is restricted to a 26 fuel position service station with 7,000 square feet of convenience store, and 30,000 square feet of commercial use on Parcel A; 218,000 square feet of commercial use on Parcel B; 47,000 square feet of commercial use and 6,000 square feet of bank use on Parcel C; and 223,000 square feet of commercial use (124,000 square feet existing and 99,000 square feet proposed) on Parcel D. Freestanding banks and drive-thru bank facilities are not permitted within the commercial uses without the approval of the Board of County Commissioners who shall review and address these uses for increased impacts.
The requested amendment results in no additional traffic impacts, and Staff has reviewed the request and finds the proposed level of development to be consistent with city code provision, and thus recommends approval.
