Explanation:

Florida Statutes Section 166.031(1) provides, in part, that “[t]he governing body of a municipality may, by ordinance, …submit to the electors of said municipality a proposed amendment to its charter, which amendment may be to any part or to all of said charter except that part describing the boundaries of such municipality.”

The City of Hollywood City Charter Review Committee was appointed to submit proposed Charter amendments to the City Commission for the November 2024 election. The Charter Review Committee proposed amendments to Article XIII of the Charter entitled “Limitation on Sale, Lease, or Purchase of City-owned Real Property.” The ballot language submitted for this initiative was ultimately deemed confusing to the electorate and pulled from consideration on the November 2024 ballot.

Following the removal of ballot initiative from the November 5, 2024 ballot, the City Commission decided to reintroduce the subject ballot initiative on the November 3, 2026 ballot. The City Commission wishes to submit the ballot initiative to the Supervisor of Elections for inclusion on the November 3, 2026 ballot.

The 2024 Charter Review Committee was created for the purpose of conducting a comprehensive study of the City Charter.  The Charter Review Committee may submit proposals to amend or revise the Charter to the City Commission.  The 2024 Charter Review Committee proposed an Ordinance amending Article XIII that would remove under sale or lease of City property the language “or by a majority vote of the City electors voting on such proposal,” and the remove the word “other” for disposition of property.  It removed the language “beach or beachfront” and added “east of the Intracoastal Waterway” and added “or City-owned and designated historic properties.”

A new subsection under Lease of City-owned Real Property was added, the new language stating “Notwithstanding the provisions of this section, any city-owned real property that is a park, a golf course or another recreational facility, a city-owned and designated historic property, or which is east of the Intracoastal Waterway which the city proposes to lease or otherwise encumber, inclusive of all options to renew, for 50 years or more must be approved by a majority vote of the city’s electors voting on such proposal.”

Fiscal Impact:

The proposed Charter amendments do not result in significant additional costs.
