Explanation:

The following request pertains to the first Dick's House of Sports store south of Tampa to include an associated sports field as part of its operations.

 

Request

 

On November 12, 2024, the Planning and Development Board heard the applicant’s request for Design and Site Plan approval within the Oakwood Planed Development zoning district. Staff provided the Board with a condition of approval which would have required the applicant to work with Staff to better the north and west facades of the proposed retail building. During the Board deliberation period, several other concerns were identified with the proposed development with regards to exposed surface parking, architectural design of the facades, and the projects alignment with the vision outlined within the Oakwood PD Master Plan. As a result, the Board deferred the item to a future Board meeting to allow the applicant time to revise the site design and elevations.

 

The item was subsequently continued as the applicant underwent the redesign process. On February 11th, the Board was presented with a revised site plan and architectural plan with improved building fenestration, material selection and pedestrian circulation. The Board provided a recommendation of approval to the City Commission with the following conditions:

 

1.                     Prior to City Commission consideration, the applicant shall investigate whether it would be feasible to modify the site layout by locating the field adjacent to the stormwater pond and positioning the building in a manner so that it lines the I-95 freeway and parking area.

2.                     Pursuant to Section 4.15(E) of the Zoning and Land Development Regulation, the City shall be allowed access on privately owned roads, easements and common open space to ensure the police and fire protection of the area, to meet emergency needs, to conduct City services and to generally ensure the health, safety and welfare of the residents of the Planned Development.

3.                     Oakwood Plaza will be maintained up to the minimum standards included within a declaration of covenants restrictions and easements as administered by the Master Developer.

4.                     Approval by the Master Developer is required prior to submitting a building permit.

5.                     Any permit, building or similar, submitted by a third-party applicant requires approval in writing by the PD Master Developer prior to submittal to the City of Hollywood.

Although the item was deferred and redesigned to improve pedestrian circulation and the materials and appearance of the building, the layout of the Site Plan has not changed due to the infeasibility of making larger changes to the site’s layout and configuration (due to the lease area, parking, outdoor recreational field, easement location, existing billboard, and canal, etc).

 

The proposed development includes a 120,000 square foot retail building, 398 surface parking spaces, an outdoor recreational field as an accessory use to the retail building, and a public plaza fronting Oakwood Boulevard. It is important to note that, while not required pursuant to the PD Master Plan, additional parking will be provided through the demolition of the existing Regal Theatre to the north of the subject site for a total parking of 1,755 stalls at the time of completion.

 

Background

 

On July 5, 2023, the City Commission approved the rezoning of the subject property from Low Intensity Industrial and Manufacturing (IM-1) to the Planned Development District (PD) through Ordinance O-2023-09. The Ordinance approved the proposed Master Development Plan at the time with the following conditions:

 

1.                     Prior to the rezoning becoming effective, Land Use Plan Amendment 20-L-32 shall be recertified by the Broward County Planning Council as required by Ordinance No. O-2022-04, adopted by the City Commission on April 6, 2022.

 

2.                     At the time of submittal of the first site plan application for the first phase of development on the subject property, and with each site plan application submittal for subsequent phases of development, the Applicant shall submit an updated Master Development Plan for all land within the Planned Development District. The updated Master Development Plan shall address: all requirements for Master Development Plans as enumerated in Section 4.15.F.3 of the City of Hollywood Zoning and Land Development Regulations; pedestrian and vehicular mobility; signage; and include revisions to the Design Guidelines that may result from changes to the Master Development Plan. The updates shall be processed administratively by the Director of Development Services, provided the changes comply with the requirements for “minor changes” in Section 4.15.G of the City of Hollywood Zoning and Land Development Regulations.

 

3.                     At the time submittal of the first site plan application for the first phase of development on the subject property, and with each site plan application submittal for subsequent phases of development, the Applicant shall submit documentation demonstrating each phase of development’s compliance with all requirements of Section 4.15 “PD Planned Development District” of the City of Hollywood Zoning and Land Development Regulations.

 

4.                     At the time submittal of the first site plan application for the first phase of development on the subject property, and with each site plan application submittal for subsequent phases of development, the Applicant shall submit evidence documenting the allocation of approved, proposed and remaining development entitlements on the subject property, consistent with the allocations for the Oakwood Activity Center. This shall include any existing development as well as any required allocations of affordable housing.

 

5.                     At the time of submittal of the first site plan application for the first phase of development, the Applicant shall submit legal documents to constitute evidence of the unified control of the entire area within the proposed Planned Development, which shall be reviewed and certified by the City Attorney and Director of Development Services.

 

The requested Design and Site Plan request before the City Commission constitutes the second site plan submittal for the Planned Development District and has met the aforementioned PD conditions outlined above.

Fiscal Impact:

Approval of this Ordinance will not fiscally impact the City as this is a proposal for a Land Use Plan Amendment.
