Explanation:
On March 12, 2019, the City held a Special Election wherein a majority of voters approved funding, through a General Obligation Bond (GO Bond), for the Tidal Flooding Mitigation and Shoreline Protection Project. The project’s purpose was to provide tidal barriers to the City owned properties most vulnerable to tidal flooding, around the two man-made inlets known as North Lake and South Lake.
The project was divided into 22 smaller projects, matching the parcel map, and classified by phases. Eight locations were classified as Phase 1 projects, and were slated for completion under the GO Bond project scope.
The City secured a design consultant for the project, approved under R-2020-275. The contract stipulated that the design for Phase 1 projects be developed from survey, planning, permitting, final design and construction engineering services. Fourteen projects were classified as either Phase 2 or Phase 3 projects. The scope of services included only the development of conceptual design for Phases 2 and 3. These conceptual drawings were utilized to apply for grant funding.
The Department of Design and Construction Management (“DCM”), on behalf of the City, submitted a grant application to the State of Florida Department of Environmental Protection (“FDEP”) for funding through its Resilient Florida Grant Program in the amount of $13,908,935.00 to assist in funding the design and construction of the Phase 2 & 3 projects.
The FDEP awarded the City a total of $14,112,000.00 to fund the design and construction of the remaining Phase 2 and 3 projects. On September 21, 2022, the City Commission passed and adopted Resolution No. R-2022-281, approving the appropriate City officials to accept and execute FDEP Resilient Florida Grant (“Agreement No. 22FRP13”) and authorizing the required matching funds to be paid from the GO Bond.
On January 18, 2023, the City Commission passed and adopted Resolution No. R-2023-032, approving and authorizing the appropriate City officials to execute the amended and restated contract to the Consulting Agreement with Cummins Cederberg, Inc. for Engineering, Surveying and General Consulting for Phases II and III of the Project, with 50% project funding of design by FDEP Resilient Florida grant.
FDEP has requested updates to Agreement No. 22FRP13’s exhibits and attachments (“Amendment 1”), and the revised Grant Work Plan provides for the City to fund all design and construction administration costs which will count as grant match, the City will fund construction costs not less than $12,204,935.00 and FDEP will fund construction costs up to $14,112,000.00. FDEP has also requested the project be titled “Hollywood Tidal flooding Mitigation and Shoreline Protection” going forward.
The Director of DCM recommends that the City Commission authorize the appropriate City officials to Amendment 1 to Agreement No. 22FRP13 between FDEP and the City and authorize the appropriate City Officials all applicable grant documents , agreements and amendments.
