Explanation:

The City of Hollywood seeks to complete the Citywide sidewalk network to improve pedestrian safety and alternative modes of transportation. Grant funding for new sidewalk construction can be secured under the Broward County Planning Organization Complete Streets and other Localized Initiatives Program.

 

On November 1, 2017, the City Commission approved Resolution R-2017-323, supporting the Complete Streets and other Localized Initiatives Program (“CSLIP”) grant application to the Broward Metropolitan Planning Organization (“MPO”) for the Beverly Park Sidewalk and ADA Compliance Project.

 

On January 22, 2019, the Broward MPO issued an award letter for the project, which was included in the Florida Department of Transportation (“FDOT”) five-year work program for construction in FY-2024.

 

On January 20, 2021, the City Commission approved Resolution R-2021-014, continuing to support the above-referenced CSLIP projects; inclusive of entering into a Local Agency Program (“LAP”) Agreement with FDOT, which serves as an instrument to receive reimbursement funds for expenditures related to the design, construction, and construction engineering and inspections services of these projects. City funds have been committed to paying for the upfront costs of the projects.

 

FDOT and the City have a LAP Agreement to reimburse the City for the design costs related to the Beverly Park Sidewalk and ADA Compliance project, up to a maximum of $900,000.00.

FDOT requires a new Request for Qualifications (“RFQ”) be issued for every project that will receive LAP funding for design services. The City has followed the requirements set forth in Section 287.055 Florida Statutes, entitled “Consultants Competitive Negotiation Act” (“CCNA”) and the City’s Procurement Code to obtain the services of engineering design consultants for this project.

 

On August 31, 2022, the City Commission passed and adopted Resolution No. 2022-223, approving the consultant ranking recommended pursuant to RFQ-4738-22-WV, and authorizing the appropriate City officials to negotiate a contract with the top-ranked firm, Kimley-Horn and Associates, Inc.

 

The Department of Design and Construction Management (“DCM”) negotiated a scope and fee with Kimley-Horn and Associates, Inc. in an amount not to exceed $531,541.00 in accordance with FDOT LAP guidelines, that staff has determined, and FDOT has concurred, to be fair and reasonable. The Director of DCM recommends the execution of the Professional Services Agreement for Engineering Design Services with Kimley-Horn and Associates, Inc., for the Beverly Park Sidewalk and ADA Compliance Project in an amount not to exceed $531,541.00.

 

 

Fiscal Impact:

Funding for the design of the CSLIP project was included in the amended FY 2023 Capital Improvement Plan and is available in account number 117.179901.54100.563010.001460.000.000. These costs will be reimbursed by FDOT once services are rendered.

 

Funding for construction engineering and inspections, and for construction services related to this project will be requested in a future Capital Improvement Plan. The Construction Engineering and Inspection services will also be reimbursed by FDOT.

 

The City will also be responsible for funding the construction contingency, which is estimated at $204,000.00 for this project. This funding will also be requested in a future Capital Improvement Plan.
