In An Amount Up To $125,000.00, And Brown And Caldwell In An Amount Up To $50,000.00 For Emergency Response And Repairs To The Southern Regional Wastewater Treatment Plant Effluent Pump Station, Pursuant To Section 38.41(C)(1) Of The Procurement Code. (“Emergency Purchases”)

Explanation:

 

The Southern Regional Wastewater Treatment Plant (“SRWWTP”) Ocean Outfall Effluent Pump Station is permitted to pump a maximum annual average amount of up to 46.3 million gallons per day (“MGD”) of treated secondary effluent to the ocean outfall.

 

On November 17, 2023, one of the two 48-inch discharge pipes in the Ocean Outfall Effluent Pump Station failed, causing treated effluent overflows from both that pipe and the east clarifier effluent trough.  The Department of Public Utilities (“Department”) initiated an immediate emergency response, which included the following steps:

 

                     Staff contacted Cardinal Contractors, Inc., to help contain the overflows and procure the necessary materials to begin repairs on the broken 48-inch pipe.

                     Staff mobilized Southeastern Engineering Contractors, Inc., to clean and disinfect the overflow-impacted areas, including N 14th Avenue from Arthur Street to Sheridan Street, Arthur Street, and one block west of N 14th Avenue on Harding Street, Coolidge Street, Scott Street, Liberty Street, and the alleyways.

                     The Department also selected the following consultants to assist with the emergency response:

o                     Hazen and Sawyer, P.C. - to evaluate the causes of the failure and help plan the repairs.

o                     Brown and Caldwell - to assist the City with responses to regulatory agencies.

o                     Tetra Tech, Inc. - to assist with environmental mitigation actions.

 

On December 12, 2023, the motor for Effluent Pump No. 1 failed, rendering the entire Ocean Outfall pumping system inoperable since Pump No. 2 was already inoperable due to the aforementioned failure of its discharge pipe on November 17, 2023.  The Department initiated a second emergency response to this additional incident as follows:

 

                     Staff contacted Cardinal Contractors, Inc. to mobilize immediately to switch the remaining operable pump motor from Pump No. 2 to Pump No. 1 so that an operable motor would be connected to a functioning pipe and the Effluent Pump Station could be placed back in service, which was accomplished on December 13, 2023.

                     Refurbish the inoperable pump motor that was previously connected to Pump No. 1.

                     Replace related worn check valves and engines.

                     Install, operate, and maintain a temporary by-pass pumping system to allow secondary effluent from SRWWTP to be conveyed to the be discharged to ocean outfall.

 

Section 38.41(C) of the Procurement Code exempts from competitive bid and competitive proposals emergency purchases that receive prior administrative approval except for the most urgent situations presenting a clear and present substantial threat to life or property where immediate action is required.

 

On December 6, 2023, pursuant to Section 38.41(C)(1) of the Procurement Code, via Memo PU-24-31, the City Manager approved and authorized the Issuance of Purchase Orders to Cardinal Contractors, Inc., in an amount up to $1,000,000.00; Southeastern Engineering Contractors, Inc., in an amount up to $200,000.00; Hazen and Sawyer, P.C., in an amount up to $100,000.00; Brown and Caldwell, in an amount up to $50,000.00; and Tetra Tech, Inc., in an amount up to $10,000.00; for Emergency Response related to the November 17, 2023, Ocean Outfall Effluent Pipe failure.

 

On December 16, 2023, pursuant to Section 38.41(C)(1) of the Procurement Code, via Memo PU-24-38, the City Manager further approved and authorized the Issuance of Purchase Orders to Cardinal Contractors, Inc., in an amount up to $4,250,000.00, for Emergency Responses related to the December 12, 2023, Ocean Outfall Effluent Pump Station Pump No. 1 motor failure.

 

Additional repairs at the Ocean Outfall Effluent Pump Station are still in progress and are anticipated to reach a total amount of up to $5,725,000.00 to Cardinal Contractors, Inc. and up to $125,000.00 to Hazen and Sawyer P.C.  Southeastern Engineering Contractors, Inc. completed spill clean-up efforts in the total amount of $112,641.58; and Tetra Tech, Inc. was ultimately not used for the emergency response.

 

The Department Director and the Interim Director of Procurement and Contract Compliance recommend that the City Commission ratify the City Manager’s approval of Purchase Orders to Cardinal Contractors, Inc., in an amount up to $5,750,000.00; Southeastern Engineering Contractors, Inc., in an amount up to $112,641.58; Hazen and Sawyer, P.C., in an amount up to $125,000.00; and Brown and Caldwell, in an amount up to $25,000.00 for Emergency Responses related to the recent failures of a 48 inch pipe and a pump motor in Ocean Outfall Effluent Pump Station.

 

Cardinal Contractors, Inc. will complete the proposed repair services within approximately eight months.

 

 

Fiscal Impact:

Funding for these purchase orders was included in the amended FY 2024 Capital Improvement Plan in account numbers 442.409903.53600.563010.001469.000.000 and 442.409903.53600.563010.000731.000.000.

 

The Department of Public Utilities staff will manage this project.  No additional staff are needed as a result of this project.
