Explanation:
The City and FEC have throughout the years entered into several Easement Agreements, granting the City a license to install road crossings, landscaping, parking areas and way finding features in Railway Rights-of-Way which the City is responsible for maintaining as well removing such improvements upon request by FEC due to interference with railway operations.
In 2017, due to the construction of the Brightline railway, FEC requested that the City remove and trim a large number of trees in conflict with the new railway in order to maintain safety and minimize pedestrian and vehicle conflicts, as railway operations require a clear area within 25 feet of the centerline of a railway, and in addition trees should be maintained with a clear understory for visibility.
On March 12, 2019, the City held a Special Election where a majority of voters decided to fund a variety of City-wide public improvement projects to be funded by a General Obligation Bond that included the FEC Corridor Safety and Landscaping Enhancement project.
The City desires to enter into an agreement with a consultant to provide Professional Civil, Landscape Architecture, Planning and Engineering design and general consulting services that are required for the FEC Landscaping and Safety Enhancement project.
The safety component of the project consists of the design of vinyl coated fencing along the entire length on both sides of the FEC corridor to prevent mid-block track crossings. The landscaping improvements component of the project consists of the beautification of the corridor through the design of landscaping elements throughout the corridor within the FEC Corridor Right of Way (ROW). The intent is to plant trees throughout the corridor, either at targeted locations or regularly along the length of the project, and to plant a hedge line along the outside of the fence, either in targeted locations or at intervals along the length of the project.
On December 19, 2018, the City Commission passed and adopted Resolution No. R-2018-400 that approved and authorized the appropriate City officials to execute Continuing Services Agreements with the five highest-ranked firms for professional engineering services for civil, landscape architecture and planning projects; one of the firms being Kimley-Horn & Associates, Inc.
The City followed the procedures set forth in Section 287.055, Florida Statutes, entitled "Consultants' Competitive Negotiation Act" ("CCNA"), and other applicable regulations, to advertise for Statements of Qualifications for engineering design services.
On July 9, 2018, the Office of the City Clerk and the Architecture Engineering and Mobility Division received statements of qualifications packages from 16 consulting engineering firms.

On July 23, 2018, members of the selection committee met for the first time to evaluate statements of qualifications and to short-list the participating consulting firms. On August 6, 2018, upon review of the statement of qualifications, the short-listed firms were ranked based upon specific selection criteria. Oral interviews were conducted with the following eight highest-ranked firms:
1. Kimley-Horn & Associates, Inc.
2. Calvin Giordano & Associates, Inc.
3. Bermello Ajamil & Partners Inc.
4. Craven Thompson & Associates, Inc.
5. Chen Moore and Associates
6. EDSA, Inc.
7. Corradino Group, Inc.
8. Atkins North America, Inc.
On November 26, 2018, the selection committee completed the evaluation process and ranked the firms following the stipulated guidelines/criteria in the Statement of Qualification package. The following ranking reflects the overall and final results of the selection process:
1. Bermello Ajamil & Partners, Inc.
2. Kimley-Horn & Associates, Inc.
3. Chen Moore and Associates
4. Craven Thompson & Associates, Inc.
5. Atkins North America, Inc.
City officials will negotiate a Professional Engineering Services Agreement with the highest-ranked firm. If City officials are unable to negotiate an agreement with the highest-ranked firm, they are then authorized to terminate negotiations with that firm and commence negotiations with the next highest- ranked firm for consideration by the City Commission at later date, if possible.
The Department of Design and Construction Management requested a proposal from Kimley-Horn & Associates, Inc. and negotiated a project scope and fee with the firm that staff has determined to be fair and reasonable and in accordance with industry standards.
The Director of Design and Construction Management and the Chief Procurement Officer recommend that the City Commission authorize the appropriate City officials to execute an Authorization to Proceed with Kimley-Horn & Associates, Inc. based upon the project scope and fee and the terms and conditions of the current Continuing Services Agreement for the FEC Corridor Safety and Landscaping project.
Fiscal Impact:
Funding for this project is included in the amended FY 2021 Capital Improvement Plan and is available in account number 333.149901.54100.563010.001184.000.000.
