Explanation:
The Department of Design and Construction Management (“DCM”) requests approval to authorize the appropriate City officials to execute the First Amendment to the Agreement with Broward County on the Shore Protection Project, Segment III (“Segment III SPP”), which shall contain certain required conditions.
On October 9, 2025, the City Commission approved Resolution R-2025-358, approving the Agreement with Broward County regarding the Segment III SPP for the access and use of City property for the Segment III SPP (“Agreement”).
Due to erosion during construction, concerns arose pertaining to certain elements of the Segment III SPP, such as compliance with the City’s Dune Master Plan, the required ratio of recreational beach width to dune width, post and rope locations and height, access points, and design and public safety considerations.
On April 15, 2026, the City Commission directed the County to stop work, City staff to review the matter with County staff, and City staff to bring back an agenda item for the City Commission to consider regarding the Agreement.
On April 22, 2026, during a Special City Commission Meeting, the City and County agreed to modifications with the Commission requesting final modifications to the Agreement be brought back to the Commission for approval.
Upon further discussion with the County, the First Amendment to the Agreement modifies the Agreement as follows:
Unvegetated dunes, consisting of sand placement only, shall be constructed in Segment 2 (Thomas Street to Cleveland Street) and Segment 4 (Magnolia Terrace to City’s southern limits).
Where dunes will be constructed in areas with existing coconut palm trees, County shall use its best efforts to 1) leave a “well” or buffer of one to two feet around the perimeter of the coconut palm tree trunks; and 2) prevent construction equipment from inadvertently impacting the tree trunks, including hand-filling sand around the coconut palm trees. City is responsible for maintaining the “well” or buffer around the coconut palm trees.
City is responsible for removing or relocating posts landward, toward the existing dune, in Segment 1 (Franklin Street to Thomas Street) and Segment 2. County will not install any rope and post in Segment 4. City is responsible for reducing post height. If City relocates posts or reduces post height, City must ensure the rope does not sag greater than eighteen (18) inches between adjacent posts and does not droop lower than three (3) feet above ground pursuant to FDEP guidelines to avoid sea turtle entanglement.
The City and County (the Parties) acknowledge that through the date this Amendment is executed by the Parties, the Parties have no claims or disputes against each other relating to the Agreement as amended herein.
Fiscal Impact:
Approval of this resolution will not fiscally impact the City as this is a proposal to execute the first amendment to the agreement with Broward County on the Shore Protection project.
The City reserves the right to obtain reimbursement from Broward County for any future costs incurred.
