Explanation:
The Owner, Craig Zinn Automotive Group, operator of Toyota of Hollywood, has requested to vacate a portion of Harding Street that is between the parking lots and the service area for the dealership. This will create a private driveway with a right turn in north bound and left turn in southbound from SR7. It will also allow to close off the east end of the roadway and remove dealership traffic from the residential areas property to the east of property. The road closure is also a request of community petitions received during the Site Plan review process.
This petition could not be a part of the Toyota of Hollywood Plat or the original site plan, as the Owner did not have control of all the properties along the north side of Harding Street at the time of plat submittal. Pulice Land Surveyors, on behalf of the Owner, has submitted application VA-17-02 requesting vacation of the approximate 471 foot portion of the above-described 50’ foot wide roadway located in Hollywood Acres Plat, described in Exhibit “A”.
The portion of Harding Street that is requested for vacation has existing public utility infrastructure that is not being removed. Access to utility providers, via a Public Utility Easement, shall be satisfied by the Owner prior to the vacation becoming effective. The Owner will also be required to close off the roadway and execute a maintenance agreement for all Improvements, including Landscaping east of road closure, installed as part of this permit as is described in the attached Exhibit “B”.
The City of Hollywood Engineering Division has processed the appropriate alley vacation application, and as a part of this process, the Engineering Division sent written requests to other affected utility agencies that they review the application and respond in writing with any objections they may have to the requested vacation. The written request from Engineering Division clearly states that if the agency does not respond within the period specified in the request, the City will assume that the agency has no objections to the requested vacation. All affected utility agencies have either not responded or responded with no objection if conditions described above are met.
Staff has determined said vacation to be consistent with the City’s Code and Comprehensive Plan objectives and that the subject alley is not required for public use, and the proposed vacation bears a reasonable relationship to the health, safety and welfare of the citizens of Hollywood, Florida.
Staff recommends approval of the vacation request.
