The Request

The proposed Design and Site Plan request has been brought before the City Commission pursuant to Article 4, Section 4.9 of the Zoning and Land Development Regulations (ZLDR). The ZLDRs provide that the City Commission shall determine the appropriate height, setbacks, lot coverage, and building separation standards as part of Design and Site Plan requests for any development within the GU zoning district.

The subject site is 1.595 acres. The proposed park design replaces and improves the existing recreational facilities while maintaining the property as a public park. The design removes parking areas from the park parcel and incorporates 38 spaces into street parking spaces within the right-of-way. The site plan also proposes new playground areas, artificial turf and sand recreation areas, pedestrian walkways, landscaped areas, picnic and seating opportunities, and a reconstructed restroom facility in its existing general location. The improvements are intended to enhance the function, accessibility, appearance, and recreational value of Harry Berry Park.

The application was reviewed through the City’s Development Review Committee process by the applicable reviewing departments and disciplines, including Planning and Zoning, Parks, Landscape, Urban Design, Engineering, Utilities, Fire, Building, and other applicable agencies. All applicable departmental requirements have been addressed through the development review process.

Background

Harry Berry Park is an existing City-owned public park located immediately north of the 1301 South Ocean Drive redevelopment site. The property is zoned Government Use (GU).

The Harry Berry design and site plan is intended to fulfill the terms of the City’s P3 Comprehensive Agreement which calls for a development program to include parking areas, recreational amenities, associated public realm and infrastructure improvements as part of the companion redevelopment at 1301 S. Ocean Drive.

The Harry Berry Park application is being reviewed independently from the companion redevelopment at 1301 South Ocean Drive. Although the park improvements are part of the broader public-private redevelopment initiative, approval of this Design and Site Plan applies specifically to Harry Berry Park and does not constitute approval of the companion Live Local building and Community Center development.

Conclusion:

The proposed Design and Site Plan represents a comprehensive improvement to Harry Berry Park and provides for upgraded recreational facilities and open space, improved pedestrian circulation, relocated public parking, and associated site improvements. The application was reviewed through the City’s Development Review Committee (DRC) process and all local, county, and state requirements have been addressed.

Staff finds the request meets all the criteria of Design and Site Plan within Article 5 & 6, respectively, of the ZLDRs and is recommending the City Commission approve the Design and Site Plan requests for Harry Berry Park and the associated staff conditions.

Fiscal Impact:

Approval of this resolution will not fiscally impact the City as this is a proposal for the approval of site plans for park design.
