The Planning and Development Board considered a proposed amendment to Article 4 of the Zoning and Land Development Regulations on May 13, 2025, and voted to forward a recommendation of approval to the City Commission. This amendment creates Section 4.24, establishing a regulatory framework for processing mixed-use affordable housing developments submitted under the Live Local Act, codified in Florida Statute 166.04151. Enacted by the Florida Legislature in 2023, the Act mandates that local governments allow multifamily residential developments by right in commercial, industrial, and mixed-use zoning districts, provided certain affordability and land use conditions are met.

 

The proposed ordinance aligns City regulations with this state law while incorporating important safeguards to uphold design quality, community compatibility, and equitable housing outcomes. The regulations apply Citywide and reflect the Act’s requirement for mixed-use development, which is triggered because only 9.06 percent of Hollywood’s land is designated for commercial and industrial uses. Developments must dedicate at least 65 percent of the floor area to residential uses, and at least 40 percent of residential units must be affordable for a minimum of 30 years. The ordinance includes requirements for proportional unit distribution, architectural consistency, and shared access to amenities between market-rate and affordable units. To maintain a pedestrian-friendly environment, the regulations require vertical integration of residential and non-residential uses and discourage surface parking, particularly near transit hubs.

 

All projects are subject to an enhanced administrative review process, which includes public outreach, submission of architectural and planning documentation, and ongoing compliance monitoring.

Adoption of this ordinance ensures the City’s compliance with state law while maintaining a proactive approach to quality design and equitable development outcomes. This past legislative session saw additional amendments to the Live Local Act, which are expected to go into force and effect on July 1, 2025. The attached ordinance has been prepared to respond to these changes.
