Explanation:

On June 10, 2025, the Broward County Commission (“County”) approved a Third Amendment to the Surtax ILA (“Third Amendment”), attached as Exhibit “1”.  To become effective, the commissions/councils of municipalities with at least 50% of the County’s total population must approve this Third Amendment along with the County.

 

This amendment added additional municipalities and the Broward County City Managers’ Association, Inc. (“BCCMA”) as parties to the Surtax ILA. Additionally, it fully restated the Surtax ILA among its members. Among other modifications, the proposed is intended to streamline, simplify, and broaden annual municipal access to transportation surtax revenues using a formula allocation for each participating municipality to supplement (and not supplant) existing city funding.  Some featured items include:

 

1.                     Identifying ways to address the status of the remaining Cycle 1 Projects and the ability for the County to terminate such projects that are not under a Surtax Funding Agreement.

 

2.                     Reprioritize the current distribution of Transportation System Surtax funding to municipalities among Community Shuttle, Capital Projects, and Rehabilitation and Maintenance (“R&M”) Projects.

 

3.                     Provide for a new formula-based funding model and allocation utilizing Municipal Centerline Mileage for R&M Projects and on-demand transportation.

 

4.                     Expanding and clarifying definitions of eligible uses to include Micro-transit, subject to certain criteria and limitation.

 

5.                     Establishing a Grant Match Program for municipalities to seek surtax funding.

 

6.                     Allowing certain decorative and functional art as elements of Transportation System Surtax funded project.

 

Staff has reviewed the Third Amendment to the Surtax ILA and finds it beneficial to the City and is recommending City Commission approval.

 

Prior Amendments to the Surtax ILA:

 

On September 20, 2018, the City Commission adopted Resolution No. R-2018-287, approving the Transportation System Surtax Interlocal Agreement (“Surtax ILA”) with Broward County (“County”) and the Broward Metropolitan Planning Organization (“MPO”) in support of the 2018 Transportation System Surtax and establishing terms for municipal projects funding.

 

Since the initial Surtax ILA was executed, there have been two amendments to the ILA. The first amendment was approved by the City Commission on September 4, 2019, under Resolution No. R-2019-251. This amendment provided the MPO evaluation and ranking of municipal Capital Projects and provided the County evaluation and ranking of municipal Rehabilitation and Maintenance (“R&M”) projects. Then on February 17, 2021, the City Commission approved the County’s Second Amendment to the Surtax ILA which further defined the relationships between the parties to the Surtax ILA bringing us to present time.

 

Background:

 

Pursuant to Section 31½-71, et seq. of the Broward County Code of Ordinances, a 30-year, 1% transportation surtax was levied after approval by referendum of the general electorate of Broward County at the General Election on November 6, 2018, to be expended for authorized transportation and transit projects in accordance with applicable law including, specifically, Section 212.055(1), Florida Statutes.

 

Broward County and its municipalities recognized the importance of a collaborative and strategic transportation plan for the County and the need for a careful analysis of proposed projects to ensure the efficient expenditure of transportation surtax proceeds exclusively on eligible projects. As a result, the parties entered into the Transportation System Surtax Interlocal Agreement, which provided for a cooperative and organized process for the municipalities to submit projects for evaluation and funding with Transportation Surtax proceed.

 

 

Fiscal Impact:

Approval of this resolution will provide a positive fiscal impact due to the change to a formula based approach to distributing Transportation System Surtax Funds.
