Explanation:
The Department of Public Utilities (“Department”) maintains and operates the City’s water distribution system, which requires the acquisition and stocking of water meters, spare parts, and accessories to perform repairs, replace obsolete units, and install new water service connections.
The Department currently utilizes Neptune Meters, which are sold exclusively through an authorized representative, Ferguson Enterprises, LLC (“Ferguson”).
On January 9, 2022, Ferguson provided a quote for the purchase of Neptune water meters for an estimated annual expenditure of $350,000.00.
On March 2, 2022, the City Commission passed and adopted Resolution No. R-2022-062, approving Blanket Purchase Agreement PA600466 (“BPA” PA600466) in an amount up to $350,000.00 with Ferguson for the purchase of Neptune meters for an initial one-year term from March 2, 2022, through March 1, 2023, with two additional one-year optional renewal periods. The BPA has already been renewed once; the current renewal expires on March 1, 2024, and the parties desire to renew the agreement for the second one-year renewal period for an amount up to $500,000.00 for the period of March 2, 2024, through March 1, 2025.
Section 38.49(C)(1) of the Procurement Code provides that, when a contract entered by the City pursuant to City Commission approval provides for one or more renewals by affirmative action of the City and the estimated annual cost of a renewal exceeds $250,000.00, only the City Commission is authorized to approve such renewals.
The Director of the Department recommends that the City Commission approve and authorize the second renewal of the BPA PA600466 with Ferguson Enterprises, LLC. for the purchase of Neptune water meters in an amount up to $500,000.00 during the period of March 2, 2024, through March 1, 2025.
Fiscal Impact
A portion of the funding for the attached BPA renewal is available in the FY 2024 Operating Budget in account numbers 442.400201.53600.552260.000000.000.000 and 442.400203.53600.552260.000000.000.000, and will be budgeted in subsequent fiscal years’ operating budgets subject to approval and adoption by the City Commission.
