Explanation:
The City conducted its last rate study in FY 2019. On September 18, 2019, the City Commission approved a five (5) year sewer rate pursuant to Resolution No. R-2019-276 and the water rate pursuant to Resolution No R-2019-277. The Department desires to have an updated financial review of the existing water and sewer rates. In addition, the Department is also required to perform the annual Large User Utility Rate, True-up and other Financial Services in accordance with the Large User Agreement dated October 1, 1990.
In order to meet the aforementioned requirements, the Department requested a proposal from Stantec Consulting Services, Inc. (“Stantec”) in the amount not to exceed $372,503.00. Stantec currently has an agreement for Professional Consultant Services Agreement Financial Rate & Management Consultant Services with the City of Palm Bay that the City wishes to piggyback on.
On May 2, 2017, the City of Palm Bay issued RFP #48-0-2017/SB - Financial Rate and Management Consultant Services. On July 17, 2017, the City of Palm Bay signed Agreement No. 48-0-2017 with Stantec for a period of twelve (12) months. The agreement provides for, by mutual written assent of the parties, extension for four (4) additional twelve (12) month periods or portions thereof, up to a cumulative total of sixty (60) months. The current extension is valid through July 6, 2021.
Section 38.41 (C)(5) of the City’s Procurement Code allows the Chief Procurement Officer to procure, without following formal solicitation procedures, all goods, supplies, materials, equipment, and services that are subject of contracts with the state, its political subdivisions, the United States government, other governmental entities, or a corporation not for profit whose members are governmental entities, public officers, or any combination thereof (“piggyback”), provided that the goods, supplies, materials, equipment or services are the subject of a price schedule negotiated by the entities listed above and is based strictly on competitive bids, quotations, or competitive proposals and not on any preference. Utilization of other governmental entities’ contracts shall be permitted only during the term of the other governmental entity’s contract.
Stantec Consulting, Inc. has agreed to provide the same services to the City under the exact pricing, terms and conditions as outlined in City of Palm Bay Contract No. 48-0-2017.
The Director of Public Utilities and the Chief Procurement Officer recommend that the City Commission approve and authorize the issuance of a Blanket Purchase Agreement with Stantec Consulting, Inc.
The Department of Public Utilities staff will manage this Work Order. No additional staff is needed as a result of this project.
Fiscal Impact
A portion of the funding for this project was included in the FY 2021 Capital Improvement Plan and the remainder is available in the FY2021 Operating Budget. Funding is available in account numbers 442.400101.53600.531300.000000.000.000 and 442.409901.53600.531300.000731.000.000.
