Explanation:
The Office of the City Attorney and the Office of Labor Relations are seeking to engage the services and enter into an agreement with a qualified firm to provide legal counsel for Defense of Workers compensation claims.
The selected qualified firm would provide legal review and advice on workers’ compensation claims as well as represent the City in the defense of workers’ compensation claims and workers’ compensation subrogation claims as requested by the City.
On August 5, 2015, Request for Proposals (RFP) Number 4460-15-RD was electronically advertised via BidSync in accordance with the City’s Purchasing Ordinance, Section 38.42(A).
RFP-4460-15-RD was opened at 3:00 p.m. on September 3, 2015, and resulted in the following eight (8) responses:

The evaluation of the proposals was based upon the following criteria as established in the RFP: Experience in Workers’ Compensation Law, Organizational Structure and Technical Qualifications of the Persons Assigned to the Project, Project Understanding, Proposed Approach and Methodology, References and Successfully Completed Similar Projects, Cost and Local Preference.
On October 6, 2015, the proposals were evaluated by a three (3) member committee representing the Office of the City Attorney and the Office of Labor Relations.
The eight (8) responsive proposals received were evaluated and the scores were compiled to arrive at the following rankings, (highest score), first choice to eighth choice:

After all Proposals received were evaluated and scored, the Evaluation Committee recommended that the proposals be short-listed to the two (2) highest ranked firms as follows:
1. Hurley, Rogner, Miller, Cox & Waranch, P.A.
2. Conroy Simberg
Funding for the purpose of hiring the firm will be identified on a project by project basis and funds are available within the Self Insurance Fund 58.
The RFP document provides for an initial term of two (2) years, with two (2) additional two (2) year renewal options.
Award is subject to the City’s receipt and approval of all insurance certificates required by the City’s Risk Manager, along with a signed Statement of Hold Harmless and Indemnity in favor of the City.
