Explanation:

On June 18, 2025, the City Commission adopted Resolution No. R-2025-218 authorizing execution of the Supplemental Grant Participation and Reimbursement Agreement for the implementation of the Railroad Crossing Elimination Grant Program “Broward County Sealed Corridor” improvements at Garfield Street Crossing with the Florida East Coast Railway (“Agreement”). The Agreement has not yet been executed by the City and remains pending.

The Agreement is between Brightline Trains Florida LLC and the City of Hollywood. Both parties agree that the Agreement should include an additional Whereas clause to provide for a ratify statement.  This change requires the City Commission to reapprove the Agreement.

The additional Whereas clause is as follows:

The foregoing “WHEREAS” clauses are ratified and confirmed as being true and correct and are incorporated in this Agreement.

The agreement that includes the ratify statement is attached as Exhibit “1” and the Office of the City Attorney and Department of Development Services recommend the City Commission approve the agreement as attached.

Fiscal Impact:

Approval of this resolution will not fiscally impact the City as this is a proposal to ratify the previously approved Brightline agreement.
