Explanation:
The City Commission passed first reading of an Ordinance to establish an Art in Public Places Program at the November 15, 2023, Regular City Commission Meeting. This Resolution is a companion item to establish associated fees when considering the Ordinance at second reading.
The Ordinance offers flexibility for developers, who can choose between three compliance (fees) options, which include installing artwork on-site, contributing an in-lieu art fee, or combining both approaches. Specific exemptions are also outlined for disaster recovery, sea-level rise projects, and developments on public property. The three options are:
1. In-lieu Public Art Fee:
1% of the cost of the proposed development project, as an "in lieu" public art fee, with a minimum payment of five thousand dollars ($5,000.00).
2. Placement of Artwork on Site:
Placement of Artwork on the site of the development project, with a minimum value of 1% of the cost of the proposed development project, which shall not be less than five thousand dollars ($5,000.00).
3. Combination of In-lieu Public Art Fee and Placement of Artwork on Site:
Placement of Artwork on the site of the development project when valued and combined with a payment of a public art fee, totals 1% of the cost of the proposed development project, which shall not be less than five thousand dollars ($5,000.00).
The Art in Public Places Ordinance is driven by a dual purpose: to enhance the visual character of the City's buildings and public spaces while nurturing a stronger sense of cultural enrichment and unity among its residents and visitors.
Through the attached resolution, staff intends to make a necessary update to the fee schedule regarding the Art in Public Places Program, by amending the Comprehensive Schedule of Fees approved on November 1, 2023.
Fiscal Impact:
Approval of this Resolution will not fiscally impact the City as this is a request to update the Comprehensive Schedule of Fees.
