Explanation:
Block 40, LLC. is the owner and developer of a mixed-use development project with 103 hotel rooms, 166 residential units and commercial space, generally located at the southwest corner of Hollywood Boulevard and South Young Circle. As part of the City’s development approval for the Project, the Developer is constructing landscape and other hardscaped improvements to enhance the Project’s frontage along State Road 5/South Young Circle/Federal Highway US1. State Road 5/South Young Circle/Federal Highway US1 is within the jurisdictional roadways system of Florida Department of Transportation (FDOT). FDOT limits its ability to enter into agreements with only public agencies. As such, Block 40 development’s landscape improvements maintenance understanding will be added, through amendment, to the City’s existing Landscape Inclusive Memorandum of Agreement with FDOT. The City’s current agreement with FDOT was amended and approved by the City Commission on February 6, 2013 under Resolution R-2013-027.
The attached maintenance agreement between the City and the Developer establishes maintenance responsibilities and understanding for the improvements. In the agreement, the Developer is required to maintain the improvements at no cost to the City.
Staff recommends approval to execute the attached maintenance agreement with Block 40, LLC. and to amend the City’s Landscape Inclusive Memorandum of Agreement with FDOT.
Fiscal Impact:
Approval of this resolution will not fiscally impact the City as the Developer is required to maintain the improvements installed.
