Staff Recommends: Approval of the attached Ordinance.
 
Explanation:
 
At First Reading the City Commission expressed concern regarding the Planning and Development Board's (PDB) approval of a Variance to waive the required six foot high concrete wall (east) to maintain the existing wood fence; as the PDB Resolution contained a scrivener's error.  The Resolution has been corrected (Attachment III) and now requires:
 
(a)      A landscape plan, meeting the City's current regulations, shall be reviewed and approved by the City's Landscape Architect and all material shall be installed and inspected prior to establishing any commercial/office use; and
(b)      In the event that the wood fence is replaced, the replacement fence shall be with a concrete masonry unit barrier in lieu of an opaque six (6) foot vinyl fence.

On April 10, 2014 the Planning and Development Board (Board) forwarded a unanimous recommendation of approval to the City Commission to:
- allocate Residential to Commercial Flex;
- rezone from Low Density Multiple Family (RM-9) to Light Intensity Office (O-1): and
- approved a Variance to waive the required six foot high concrete wall (east) to maintain the existing wood fence.
Should the City Commission approve the requests, for the property at 2535 N. 40th Avenue, the current property owner anticipates utilizing the existing building as an office.
