On November 11, 2023, artist Stephanie Cunningham presented Project P-2023-093 to the City Commission, proposing a conceptual design for a COVID-19 Memorial initially planned for installation at Kiwanis Park. The Commission directed staff proceeding with project implementation

 

Subsequently, Community Development Block Grant (“CDBG”) funds were identified as a potential funding source. However, Kiwanis Park was found ineligible for CDBG funding. After reviewing alternative City park sites, Bob Butterworth Park was selected due to its eligibility for CDBG use and its suitability for the memorial. This location change was fully supported by the artist.

 

The project design required additional structural and wind load calculations not included in the original concept. Bermello Ajamil & Partners, Inc. was retained under the City’s continuing architectural services contract to prepare the necessary permit-ready construction documents.

 

On May 8, 2025, the City issued Invitation for Bids IFB-312-25-WV (“IFB-312-25-WV”) via www.Opengov.com.

 

Only one bid was received in response to the IFB-312-25-WV, and the pricing exceeded the anticipated Project budget, triggering Davis-Bacon Act requirements under applicable CDBG thresholds. IFB-312-25-WV was cancelled

 

On June 25, 2025, the City re-advertised the Project IFB-333-25-WV for the COVID-19 Memorial at Bob Butterworth Park on www.Opengov.com.

 

Bid Results:

Tower Contracting Corp was the sole bidder.

 

The Department of Design and Construction Management and the Office of Procurement and Contract Compliance reviewed and evaluated the submitted bid in accordance with Section 38.43(F) of the City’s Procurement Code and determined that Tower Contracting Corp submitted the lowest responsive and responsible bid and offered the best overall value to the City.

 

On August 14, 2025, a Notice of Intent to Award was posted on the City’s website and www.Opengov.com. No bid protests were received during the protest period.

 

An additional $25,000.00 of Owner’s Contingency has been included to cover unforeseen conditions or necessary adjustments that may arise during construction, which are not accounted for in the base bid and in order to ensure timely completion of the Project without delays. It shall only be used as requested and approved by staff and any remaining value to be returned to the City.

 

 

Fiscal Impact:

Funding for this project was included in the amended FY 2025 Capital Improvement Plan and is available in account numbers 115.160101.55400.584380.001409.000.000 and

334.309901.57200.564530.001820.000.000.
