Explanation:
SCI Funeral Services of Florida, LLC (“SCI”), is requesting to vacate a 15’ wide alley bisecting two properties, both owned by SCI. The properties are generally located at the southeast corner of Taft Street and North 64th Avenue.
The alley is an L-shape running between Taft Street and North 64th Avenue. Its purpose, at the time, was to provide access to a gas station that once existed at this corner. The gas station has been demolished for decades, making the alley obsolete as it no longer serves any public access purpose.
In 1961 the alley was dedicated to the public by the “Hollywood Memorial Gardens No. 4” Plat, recorded in Plat Book 54, Page 16 of the Public Records of Broward County, Florida.
From review of existing utilities within the alley, a concrete power pole guy wire and anchor owned by Florida Power and Light (“FPL”) currently exists. As a requirement of the vacation, the Owner has provided a 10-feet by 25-feet utility easement that has been accepted by FPL for maintenance.
Staff has determined the vacation to be consistent with the City’s Code and Comprehensive Plan objectives and that the subject alley is not required for public access use, and the proposed vacation bears a reasonable relationship to the health, safety and welfare of the citizens of Hollywood, Florida.
Fiscal Impact:
Approval of this ordinance has no negative fiscal impact the City as this is a request to vacate a platted alley. Instead of the City maintaining the alley, it now becomes the responsibility of the future property owner.
