Explanation:

On February 26, 2024, a Notice of Zoning In Progress was advertised in a newspaper as required for a text amendment to Articles 2 and 4 of the Zoning and Land Development Regulations (ZLDR) to provide a clear definition and establish performance standards for K-12 schools.

 

In accordance Section 5.3.N(1) of the ZLDR, a freeze on permits shall continue for a maximum period of six months, provided, however, such six month period may be extended for up to an additional six months by passing a Resolution of City Commission when the scope and magnitude of the petition requires additional time for study and deliberation.

 

On March 12, 2024, the Planning and Development Board heard the proposed text amendment and made a recommendation to forward the item to City Commission for approval, and subsequently, on May 15, 2024, the City Commission heard the proposed text amendment and requested several changes, thus requiring a second, first reading of the proposed text amendment.

 

On June 5, 2024 staff intended to present the requested revisions to the text, however decided to withdraw the item to evaluate different options thus requiring further analysis by staff and legal counsel.

 

Final consideration of the text amendment requires two readings for adoption of an Ordinance. As a result, the time needed to bring this amendment to the City Commission for consideration will extend beyond the expiration date of the Zoning In Progress, which is scheduled to end on August 26, 2024.

 

Staff and legal counsel recommend the Commission extend the Zoning In Progress for an additional six months to February 26, 2025 which will allow the needed time to finalize the regulations to ensure the development of K-12 schools is consistent with the community's goals.

 

 

Fiscal Impact:

Approval of this resolution will not fiscally impact the City as this is an extension of the existing Zoning In Progress.
