Explanation:

The State of Utah Omnia Cooperative Contract Master Agreement, Contract Number LS4679 (“Contract Number LS4679”) enables registered business customers to utilize an online digital marketplace to purchase products and services for business purposes and to access and use a set of features, services, software and applications specifically intended for business customers (“Online Marketplace”).

 

On May 22, 2024, OMNIA Partners issued Request for Proposal Solicitation Number TR24-8 (“RFP”) for an online digital marketplace to purchase goods and services that may be used routinely and needed quickly to address the everyday needs of public entities, schools, and universities.

 

The RFP was awarded to Amazon.com Services LLC, d/b/a Amazon Business (“Amazon Business”), under Contract Number LS4679.

 

The current term of the Contract LS4679 is from May 6, 2025 through May 5, 2030.

 

Amazon Business has agreed to extend to the City the same pricing under the terms and conditions set forth in Contract Number LS4679 for the Online Marketplace.

 

The Participating Addendum Agreement shall commence from the date of Commission approval through May 5, 2030, in an annual amount up to $500,000.00.

 

Contract Number LS4679 authorizes eligible users and Participating Public Agencies to utilize the Contract through a Participating Addendum Agreement.

 

Section 38.41(C)(5) of the Procurement Code allows the Chief Procurement Officer to procure, without formal solicitation procedures, all goods, supplies, materials, equipment, and services that are the subject of contracts with the state, its political subdivisions, the United States government, other governmental entities, or a corporation not for profit whose members are governmental entities, public officers, or any combination thereof (“piggyback”), provided that the goods, supplies, materials, equipment, or  services are the subject of a price schedule negotiated by the entities listed above and is based strictly on competitive bids, quotations, or competitive proposals and not on any preference and such utilization of other governmental entities contracts shall be permitted only during the term of the other governmental entity’s contract.

 

The Chief Procurement Officer recommends that the City Commission approve and authorize the appropriate City officials to execute a Participating Addendum Agreement with Amazon Business for the Online Marketplace, from the date of Commission approval to May 5, 2030, in an annual amount up to $500,000.00.

 

Funding for this Participating Addendum Agreement has been appropriated and exists in the Citywide Departmental general funds.

 

 

Fiscal Impact:

This Participating Addendum Agreement is for citywide usage and funding will be identified on an as needed basis by each respective department subject to available funds.
