Explanation:
The Department of Public Utilities (“Department”) provides retail water service to approximately 150,000 residents of the City as well as portions of the Town of Davie, the City of Dania Beach, and the Seminole Tribe of Florida reservation. The City also provides wholesale potable water service to Broward County through pipelines that serve the County’s retail water customers located in its Districts 3A and 3B/C.
The City’s water system consists of wellfields, a water treatment plant, and a distribution system. The Department’s water system includes approximately 700 miles of water main pipe ranging in size from 2 to 36 inches in diameter. This entire system is regulated under the Federal Safe Drinking Water Act (“SDWA”). The SDWA establishes protective drinking water standards for more than 90 contaminants, including lead and copper. Lead and copper primarily enter drinking water through plumbing materials. Exposure to lead and copper may cause health problems ranging from stomach distress to brain damage. The Environmental Protection Agency (“EPA”) revised the existing Lead and Copper Rule (“LCRR”) in 2021, to enhance monitoring, treatment, customer awareness, and lead service line replacement requirements.
Department staff have determined that service line material verification, using hand digging or vacuum digging, is necessary to develop the City’s service line material inventory, as required by the EPA and the LCRR.
Section 38.43 of the Procurement Code states that when the estimated annual cost of goods, supplies, materials, equipment, or services exceeds $50,000.00, a formal solicitation process shall be completed that may result in a written contract(s) and/or purchase order(s), after due public notice inviting bids or proposals.
On May 20, 2024, the City Commission passed and adopted Resolution No. R-2024-087, the City Commission authorized the execution of a unit price contract with National Metering Service, Inc. (“NMS”) in the amount up to $414,275.00 to verify water service line materials. This contract provided an initial term of one year, with an optional one-year renewal term, at the option of the City and under the same terms and conditions. In addition, on July 21, 2025, the existing contract with NMS was extended for up to 120-days.
The Department desires to renew the contract with NMS based on their performance, prompt support to meet previous submittal deadlines, and familiarity with the City’s water service infrastructure. The renewed contract will allow the Department to obtain the additional excavations required to satisfy the EPA’s validation pool of sites.
This agenda item seeks the City Commission’s approval and authorization for the appropriate City officials to execute the renewal of the unit price contract with NMS for a one-year period for construction services related to verifying water services line material in an amount up to $100,000.00, in accordance with the terms and conditions of the contract.
Fiscal Impact:
Funding for the project was included in the amended FY 2026 Capital Improvement Plan and is available in account number 442.409904.53600.531300.001915.000.000.
Department staff will manage this project. No additional staff are needed as a result of this project.
