Explanation:
The applicant is requesting the allocation of one flexibility unit for the property located at 1402 North Surf Road.
The subject site is a single parcel and comprises approximately 6,628 square feet (0.15 acres). The site is home to Senor Frogs restaurant, which uses the first two floors and leaves the third floor vacant (originally intended for storage).
On April 14, 2026, the Applicant appeared before the Planning and Development Board (Board), for a recommendation of approval to City Commission. The Board voted unanimously to approve the recommendation of the Flexibility Unit to the City Commission.
BACKGROUND
The Broward County Land Use Plan establishes a set of “Rules of Flexibility” that govern adjustments to residential density and non-residential intensity. These rules are intended to provide local governments with the ability to make minor modifications to their adopted land use plans without requiring corresponding amendments to the County Land Use Plan, thereby maintaining consistency between municipal and county planning frameworks.
In May 2023, the Broward County Planning Council formally approved the City’s request to consolidate the seventeen existing flexibility zones into a single Unified Flexibility Zone. The City’s Unified Flexibility Zone boundaries align with the municipal boundaries and eligible lands are those designated as “Residential” or “Commerce” in the BrowardNext Future Land Use Plan. At the time of writing, the City has 3,886 flexibility units which consists of all currently available Flexibility Units, Reserve Units, and Affordable Units within the City. Allocating one unit leaves a remaining balance of 3,885 flexibility units.
The subject property, located at 1402 North Surf Road, currently consists of an existing three-story commercial building totaling approximately 7,217 square feet. The property has a General Business (GB) land use designation.
The City of Hollywood’s Comprehensive Plan permits residential uses on lands designated General Business when they are located within the same structure as commercial uses, provided the residential floor area does not exceed 50 percent of the total building floor area. The proposed residential unit is approximately 2,247 square feet, which is less than 50 percent of the total floor area of the existing commercial building.
The property currently has one open violation (V25-22935) and has submitted a building permit application (B25-102683) to address and correct the issue. Allocating one flexibility unit authorizes the zoning use, allowing the plan review to be completed and the permit to be issued.
Conclusion:
In summary, the request is to allocate one (1) Flexibility Unit to allow for a residential use within an existing three-story commercial building, and the subject property has a General Business (GBUS) future land use designation. The request is intended to facilitate the adaptive reuse of the third floor in a manner that aligns with the intent of the Comprehensive Plan.

The approval of this resolution will not fiscally impact the City.
