Staff Recommends: Approval of the attached Ordinance.

 

 

Explanation:

On May 18, 2016, the City Commission granted approval of an amendment to the Hillcrest PUD and Final Site Plan to allow for the redistribution of 645 residential units and amenities on portions of the Hillcrest Golf Courses.

On July 3, 2017, the City Commission granted approval of an amendment to one Site Plan condition for Phase II. The Applicant’s request did not include any changes to the Site Plan, or any changes to the other previously approved conditions.

 

To date, over 300 permits have been issued with approximately 175 receiving a C/O for Phases I and II of the development. In an effort to address the requests of prospective homebuyers and the dynamics of an ever changing residential market the Applicant is currently proposing three amendments:

 

1.                     Reconfiguration of certain residential lots within Phases I and II.  This reconfiguration will allow for an unpopular townhouse model, Trailwood, to be replaced with the more desirable, Raritan model. Additionally, this amendment requires a Plat amendment in order for the Site Plan changes to occur. Also included in the Plat amendment is a modification to one Plat condition of approval, regarding the required intersection improvements at South 52nd Avenue & Washington Street. The Plat amendment is a separate item, R-2019-109 which was granted City Commission approval on May 1, 2019.  

 

2.                     In addition, the Applicant is requesting an amendment to remove one of the Site Plan conditions for Phase II. This request coincides with the proposed Site Plan amendment to relocate townhomes which are in conflict with an existing 6’ wide FPL easement. The original plan was to vacate and relocate this easement. However, the Applicant finds that this process is cost prohibitive and time consuming thus prefers to relocate the townhomes. As such, the Applicant is concerned that the language used in the condition is no longer necessary to satisfy a requirement of the condition.

 

3.                     Finally, the application will memorialize the land swap Tobin Properties (1100 HILLCREST DRIVE LLC), within Phases 1 and 2. Within Phase 1, a 0.31-acre square parcel located at the far end of the Hillcrest Tennis Center parcel was deeded. A small rectangular parcel at the west end, just west of the cul de sac, of Phase 1 was also deeded. This parcel is approximately .09 acres. In Phase 2, a 1-acre land swap with the Charter School, located in the rear / west of the property was also deeded to 1100 Hillcrest Drive, LLC. The Applicant’s request does not include any other changes to the Site Plan, or any changes to the other previously approved conditions.

 

The Applicant has worked with Staff to address concerns regarding the amendments. Additionally, the Applicant has worked with the City Engineer to ensure any potential impacts by the proposed change are mitigated and the conditions of approval are sufficient

 

Staff finds the proposed amendment consistent with the Criteria set forth by the Zoning and Land Development Regulations as well as the City-Wide Master Plan and therefore recommends approval.
