Explanation:
First Reading:
The City originally proposed to prohibit tents and canopies, roller skating and roller blading, and bicycles with more than two wheels, as well as establish beach closing hours. The Commission rejected the prohibition on canopies, roller skating, and roller blading. The Commission requested to prohibit bicycles greater than 48 inches and well as “banana peel” tricycles and requested staff to appropriately define “banana peel” tricycles. The Commission requested to allow open air canopies no greater than 10 feet (with an exception for canopies less than 36 inches designed for babies), increase the distance between canopies to 20 feet and remove the distance separation for umbrellas. The Commission requested to amend the proposed closing hours to 12:00 a.m. to 5:00 a.m. The City Attorney advised staff to return for a new first reading to include the proposed amendments.
Staff amended the ordinance to prohibit recumbent tricycles or similar devices on which the rider sits in a reclined, legs forward position and bicycles greater than 48 inches wide. Staff addressed the changes proposed by the Commission and removed the prohibitions on canopies and roller skating/blading. Staff amended the proposed closing hours as requested.
Second First Reading:
Staff presented the Commission with further changes on the dais, to include a prohibition on low-profile recumbent cycles with a wheel diameter of less than 24 inches and an exemption for devices used for the mobility of disabled individuals. The Commission clarified the permissible canopy dimensions and requested to permit lounge chairs with attached cabanas. The Commission requested to revert to the original language of Section 99.02(A)(7), which provided a distance separation for umbrellas, and the original language of Section 99.02(A)(8), which allowed surf fishing during the hours of 6:00 p.m. to 9:00 a.m. The Commission also clarified the area for which closing hours would be established to include the public sandy beach and any dunes.
Second Reading:
Staff has amended the ordinance to include the changes requested at the second first reading.
Fiscal Impact:
Approval of the attached ordinance will not fiscally impact the City.
